I own70 acres of zoned farm land I was told 4 years ago to get rid of my cows and was told they were contaminating a near by stream.I got rid of the cows and am now being charged a 1,000.00 per day fine to clean up this. My lawyer that I hired ended up becoming the town lawyer and I feel Im being railroad so the town can take my land.Can they legally fine me like this and do you think I can get a lawer to take this case just on the fact to sue the town for harrassment and wrongful fine and my lawyers actions or inactions. Im getting no help from anyone and am an old time farmer with not much money and they know I cant last. My friend that is an enviornmental person said it could have been affected just by ducks birds, etc. Please remember this was a running farm for about 90 years. I know laws change but I complied when asked to get rid of the cows and think this is just a small town conspiracy to take my land. Can you please, please give me your opinions so I know where to start. Thank You so much.

First of all I am not a MD attorney and you should contact one.

Second, if your attorney became the Town attorney he has a conflict of interest and cannot represent the town in your matter. You may have a malpractice claim against him and the town. More information is needed to determine that but you need a MD attorney.

As to your environmental issues, you do not indicate what the issue of contamination is. Without that information it is impossible to advise you.

I suggest you find another attorney immediately including one that does legal malpractice and one that does environmental law.
