Need Lawyer advise about backtaxes not paid

Hello:

I am writting in reference to one of my employee's who just came to me yesterday, telling me after all the years being friends he has not submitted his taxe return in approximatley 20 years .At first i was upset with him but after talking to him he wants to find a lawyer that he can afford to help him right the wrong he has done and move forward. Do you have any ideas i don't know what to say to him or do, I never had or heard of such a thing around me before, yes in the world but not this close to me, Please help me email me [email protected]

The irony is that, if he truly is and has been an employee, he may not owe back taxes due to payroll withholding -- the last time we did one of these, the taxpayer actually would have been entitled to tax refunds in most of the years, but lost them because no timely returns were filed. Anyway, the best practice is to retain tax counsel with experience in criminal tax cases, in order to first ensure that the chance of prosecution is minimized. Then, the lawyer retains a CPA to prepare all overdue tax returns; once returns are filed, the chances of criminal prosecution decrease markedly. Depending upon whether there are in fact taxes owed, the next phase is to arrange for payment.

The first matter is to discern whether there is a tax liability. I am an attorney with audit and accounting experience to handle most business related legal matters. After a tax liability is established, contact with IRS and the state(s) department of assessment and taxation is needed. An attorney's service is highly recommended.
