Son Traffic Accident now being sued

My son was in a traffic accident last June and has been served with a lawsuit now (Jan 09). He is a fulltime college student who lives in Maryland and has no income. He has liability insurance. Can he personally be sued?

When a person is sued even with insurance, they are sued in their own name. The insurance stands behind them. But one does not sue the insurance company.

However, they cannot sue if they have already been paid in full. Therefore, the insurance company needs to get busy and try to settle the case.

The insurance company should provide a lawyer for defense. If not give me a call.
