Legal Question in Wills and Trusts in Maryland

probate

POA declined to give Executor money

that is supposedly in decedent/poa

name. This money did not go into

the pool involved with probate. All

money has been distributed to

siblings by executor. POA never gave

an accounting of where/how he

spent the money for my mother over

a 4 year period. Is the POA

responsible to do this, what recourse

can I the executor take if POA

decides to not give me an equal

portion of the estate money.

POA said he would not do anything

until I finished probate. Probate

completed on mid May 2008.

I want to respond to your question so that it does not get ignored, but my response is essentially that you need to actually discuss, at least on the telephone, the underlying facts of the situation with an atty in order to get a meaningful response. It is a very fact-driven situation and not helpful to answer theoretically. I, or another atty in my firm would be happy to spend a few minutes on the telephone. You could also call a lawyer local to your area that practices Probate/Elder Law.
