Over heard my new boss say he had my replacement

On conference call I heard my boss say that he had my replacement. He had given me a vebal counseling the week before and said my job performance need to improve. He also said he would give me an action plan for 90 days. I never received the written action plan. i sent him a mini plan so that i could get started on my improvement. I spoke to him the day after the call and told him i had heard what he said, he said i misunderstood, but he would be talking to me next week and give me 4 options(1- give 110% including off shifts, weekends 2- severence package 3-try to do the job, and still might get terminated 4- termination). Do i have any recourse. This is the first time i am being warned and have worked for the company 6 years. I do have a sexual harassment i filed 1.5 years ago, HR said it was a he/she said, and no futher action taken.

Generally, an employment relationship is "at will". This means that either the employer or the employee can sever the relationship for virtually any reason, and at any time. If the company has an employees' manual that sets out a procedure for termination, you should be protected by that procedure. This may include the right to appeal to a higher level of authority, a hearing, etc. If there's nothing in writing, you don't have any real protection against discharge, unless it violated an express law--such as race/sex discrimination, etc.
