Workers Comp Time Limits

I was injured at L3, 4, 5 & L5S1 approx 3 yrs ago in July. I was getting my comp then they stopped, went to trail was denied. I am still having a lot of problems, job ended so I am not working now. I have to take medication every day and have epidurial blocks completed on a reg. basis at John Hopkins. Surgery is an option but do to the complications, my age, the fact that scar tissue will build etc., it is not an option now. I can get around but still have bad days, if I go off med's (tried because we wanted anotehr baby but can't go long enough off the meds to not do harm to afetus) then I can get around well at all. I am worried that my limit of time for a settlement is coming up. My attorney has not returned my call or asked for mileage etc. I think an appeal could have been filed to the ruling but he did not it??? IS my time running out?? Should I try to go to settle? Or what do I do next?

I presume from your inquiry that you received an order from the commissioner hearing your case denying you benefits. You can appeal it within 30 days of the date of the order. The appeal consists of a trial in the Circuit Court in your county either before a judge or jury. If you have new medical evidence that might support reopening your case at the administrative level, you can file a petition to reopen. If your attorney doesn't want to continue with the case, you should try to find another worker's comp lawyer to help you with the case.
