Legal Question in Credit and Debt Law in Massachusetts

Morning, I have a credit card account I haven't paid in 1 year. They offered me a settlement for half of the $17,000.00 that I owe, but I can't do the payment arrangement they are offerring. I countered, but they said no, and are going to send me a summons. What do I do?

We assist clients in your position all the time. If you have the right representation, lawsuits are not all that scary. We advise our clients to open up a separate savings account and begin to put away money each month toward a settlement.

Once a lawsuit is commenced against you, an attorney can protect your rights avoid a judgment against you until you are ready to settle - usually up to a year after suit has been filed. Our clients use that time to build up their settlement reserve and then tell us when they have the ability to settle. In the meantime, we handle all court appearances, all court filings and discovery, and communications with the creditor or its counsel so you don't have to.

There is no guarantee that the same offer of 50% settlement will be made to you after a lawsuit is filed, but most likely the same or similar offers will be entertained. I recommend counsel only because debt collection firms will take advantage of the consumers lack of knowledge of court procedure and rules to obtain a quick and lasting judgment.
