Legal Question in Family Law in Massachusetts

hello I have a 4 month daughter and I'm not with her father and is not married. Right now my daughter and I live in Brookline MA with my mother. My mother is a CNA at a hospital in Boston and I am a full time student. Her father is unemployed so is his mother. He lives with his mother. Would he be able to take my daughter for weekends or full time?

If you mean can he take custody of your daughter, not likely. Assuming he is recognized as the father either on the birth certificate or by a paternity test, he is entitled to visitation.

Assuming he is the father he is still obligated to pay child support even if unemployed, he can defer payments until he gets a job, but he still is responsible for providing for the child.
