Legal Question in Family Law in Massachusetts

Hi,

I and my wife live in MA and we have four daughters all minors. Both I and my wife are not originally from US and both of our families are not living in the US. I would like to create a will of children custody to my family overseas should something happen to both me and my wife. Can I prepare such a will? If yes, what kind of forms do I need and what are the guidelines for preparing the will.

Thanks

~E

As a Massachusetts residents you and your wife would each create a Will. In the Will you would name whomever you want to act as Guardians (custody of your minor children) and Conservators (managers of any money left to your children).

You need a Massachusetts Will, and while there are forms and services that do this, I would strongly suggest when it comes to the safety and well being of your children, that you have an attorney assist you.

Please feel free to contact me if you have any questions.
