My wife has tried to leave with my 4 kids before now she left by herself and wants the kids what can I

do for full custody she left to another state but left them With me, she abuses them verbally , also my kids don't want to be with her do I have a case?

You are entitled to file for divorce, if you wish, and to request an order granting you custody of the children during the pending divorce. When you ask whether you have a case, it is not clear whether you mean "do I have a right to ask for custody" or "will I get custody".

The answer to the first question is yes. The answer to the second question is that it really depends entirely on what is in the best interests of the children. My advice would be for you to retain counsel to commence divorce proceedings and obtain custody right off the bat. While it is not always the case, the party who obtain temporary custody is likely to obtain custody after divorce.

You have a couple options. You can file for divorce as previously stated and then request sole legal and physical custody of the children.

The alternative is to just file a Complaint for Custody/Support/ Visitation and request sole legal and physical custody.
