Auto accident with children

I was involved in a car accident a month ago and have been out of work. The accident was not my fault my question is...one of my children has scars on her legs from the accident and her medical bills have not even come close to the $2000.00 can she be compensted for these scars. I still have to get another MRI for my back and not sure when i will be able to return to work. How come you need $2000.00 in medical bills before you can even have a claim. can you still ahve a claim for pain and suffering even thought my bills are not alot cause the insurance has paid most of it.

Here's the law describing the threshold for bringing pain and suffering claims. http://www.state.ma.us/legis/laws/mgl/231%2D6d.htm You'll notice an exceptions that may apply to the children's claims. The scars should be photographed now.
