Gift or Loan

My wife's friend had GIVEN us some money over the last few years to help us with some bills.When she offered us the money we told her we couldn't repay her, but she insisted that she wanted to help and didn't want us to repay her. My wife and her friend had a falling out a few months ago and are no longer friends.Her friend is now sending us letters wanting the money back that she GAVE us. Over the past years she NEVER mentioned the money at all..it wasn't until the friendship fell apart that she is asking about the money.She is doing this because she is bitter. What can she do? Can she sue us?

Yes???

1. First, how much money was given;

2. What was the form of payment; and

3. When were the funds given;

Short Answer:

1. Any person can file suit;

2. There is a time limit during which such action is filed;

3. The amount of money requested will indicate or suggest the best path;

4. Do not respond to the letters until you consult an attorney, especially if the funds requested a more than a few hundred dollars.
