can my boss hold my check till i sign a resignation form even though i never quit

Basically no. If a company fires an employee, his wages must be paid on the date of termination. Why is your boss asking you to sign the resignation?

Sorry for the delay; I just got out of a full day in 3 courts...

If the check is for work services you've already performed, your employer can't hold your check at all. Holding back wages is a serious offense, perhaps even criminal.

And why is the boss demanding you sign a resignation? Has he fired you, and he's offering to "let you" resign?

What kind of employment is it?

Do you have an employment contract? Do you have a personnel manual?
