Legal Question in Employment Law in Massachusetts

Exempt status

How do I know if I am an exempt employee? I am listed as exempt at an employer, but have done similar employment at other agencies and was non exempt. At the employer where I am considered exempt, I have less administrative powers and authorities, less say in hiring/firing/discipline. I've read the FLSA and I don't believe I fit exempt status (not least of all due to my admin. duties consisting of 50% or less of my job time). What can I do to find out for sure? I have a copy of my job description (revised in 2003), which actually gives me more authority than I have in reality.

Re: Exempt status

I would need to see the job description you refer to and an outline of your actual functions by per cent in the average week.
