Legal Question in Employment Law in Massachusetts

Rescinding job offer

I moved to MA to work for a firm. I had the job offer from them signed in writing. Then a few weeks ago the offer was rescinded because of the economy. Do they owe me any financial compensation?

Re: Rescinding job offer

The short answer is yes. If in reliance on the promise of employment you relocated to Massachusetts, then you would be entitled to compensation for the cost of relocation as well as compensation you should have received had you actually become employed by the company. The terms of the offer letter you received might govern the extent of your rights (e.g. if the offer provided that you would be paid an annual salary, you could argue that you were guaranteed employment for at least one year). The law imposes upon you an obligation to limit your damages by diligently looking for other employment.

I spent a great deal of time handling cases in this area and would be pleased to speak with you about the matter. My office also offers non-traditional fee arrangements in appropriate circumstances. Please feel free to contact me.
