State income tax statute of limitations

The statute of limitations is 6 years in MA, I have paid the tax , for 2002, they are trying to collect the penalties through

an attorney. Can I send them a letter

stating it is uncollectible?

The statute of limitations with respect to the assessment of the Massachusetts State Income Tax depends upon the basis of the assessment ( eg; false or fraudulent return= no statute of limitations, substantial omission of gross income= 6 years from the later of the date the return was filed or due etc...)
