You need to probate your husband's estate with probate court. If he had a will, you file a probate. If he didn't have a will, you file an administration. You need to know the assets that are in the estate before you file because there is one procedure for small estates and a different procedure for all other estates. You may be able to go to probate court and take care of this. However, you may need the assistance of a lawyer. You should also know that there are expenses associated with this such as filing fees, possibly publishing in a newspaper, and other expenses.
