lost retainer

My attorney died before court hearing and I was told by his son, also an attorney, that his father's estate is going through probate so he can't refund my retainer. Contacted Bar Assoc. and was referred to Client's Security. Left messages and get no reply.

You must go to the CSB web site (google Massachusetts client security board) and download the form. Read the instructions and the form carefully to be sure that the claim will be accepted and processed.

Keep trying. Usually a retainer is in an IOLTA, escrow account, and therefore the funds should become available,

The unearned retainer should be placed into an iolta account which is not part of the estate. An Executor/administrator of the estate will have to be appointed however if there is not another singor on the account ( ie another lawer in the firm). That may be the delay as well.
