Legal Question in Credit and Debt Law in Michigan

My brother in law was prosecuted by the Fed. government almost 3 years ago for bank embezzlement of almost 1 million. At the time he had also ran up credit card debt in his parents name to the tune of almost 70,000. My brother in law approached my mother to loan his parents the money to pay off the debt or else they were going to have to pursue charges of fraud against him. My mother agreed to loan his parents the money and wrote checks to pay off their credit cards. At the time their money and some of my mother's money was tied up in the fed. gov. suit because my brother in law had taken from them and they were waiting to get their money back from the gov.

Since the loan almost three years ago, my mother has not received any kind of repayment. She did not have a contract or written agreement with them. I think about a year ago she sent his parents a certified letter asking about repayment and received a letter from an attorney stating they do not owe her anything and not to contact them again re: this matter. Does she have any recourse at this point? Thanks for your help.

Why did she loan 70,000$ to someone without getting a promissory note in return? Why didn't she take action when the lawyer responded? This case is not impossible, but very difficult.
