Legal Question in Credit and Debt Law in Michigan

Credit and Debt Collection

I'm wondering if I really need an attorney. I really cannot afford one and I'm going to have to attempt this on my own. I'm wondering because my defense is including the MI statute of limitations, and the dates are really close, on the 11th month and day. (6/2002) was the original date of complaint. I think another bank bought a bad account and decided to try to collect at the last second. I was under the presumption the acct. was charged off and closed in July 2002. Until now, with a full blown law suit against me.

Re: Credit and Debt Collection

If you think you can adequately represent yourself, then give it a try. You will need to acquaint yourself with all the applicable statutes, case law, and court rules. There are also additional issues when a debt purchaser is involved because they must meet their burden of proof. This is usually accomplished if they can provide documents and affidavits that comply with statutes and court rules.

All things considered, maybe you can't afford to not have an attorney, depending on the amount of money involved.
