Legal Question in Credit and Debt Law in Michigan

I have received a summons and complaint from my county courts. My husband and I both lost our jobs and cannot pay our credit card minimum payment. We are losing our house and vehichles. We are TRYING to live on my now part time job which brings in $200 a week. My question is that the only thing we own free and clear is a motorcyle. I understand they can get a judgement to garnish my wages and any bank accounts but can they take away the motorcycle that we own? 2 months ago I offered to pay this credit card company $25 a month but they would not except this. The credit card of course is unsecured. Could they get an order to take the bike?

Absolutely. If you don't defend the case and the plaintiff gets a judgment, the bike can be taken. You can also have the judge order a payment plan in lieu of taking personal property. Visit www.kliszlaw.com to discuss. Tim Klisz
