If two people are still married and living in the same house, and one wants a divorce, (they have 3 children together) can one spouse take the children and move to another state, or even just leave for a week or so, without telling the other parent where they are? is it actually illegal? my husband says it's not, I say it should be.

If no one has yet filed, there is no support order. Therefore, there is no order preventing removal of the children from the state. Even if there was, the order prohibits permanent removal, not simply going on a trip. Your husband is wrong. Have a nice trip. William S. Stern

Both parents have the same rights to travel temporarily with the children unless the judge says something different.
