Legal Question in Family Law in Michigan

Divorce, when to start?

Hello, I am from Michigan, my mother is getting a divorce she is 77 years old, my father is the same age. They have been waiting to sell the house and try and have an uncontested divorce. This may not be possible because they do not agree on a few items. The house finally sold and they have a closing scheduled in March. There is a pension my father gets plus social security totaling $30k a year, while my mother only gets $5k a year with social security. This needs to be eqauled out at $17500 each per year. There is also a dispute over a $10k charge that my mother needs to get half of. Their house is sold at $300k.

My question is this: Knowing how expensive attorneys are, I have been planning to let them get the money from the house and divide as many things as possible without any assistance. Then after she gets the money from the house I plan on having her file for divorce and letting the attorney take care of the pensions/income and maybe fighting for the $10k charge my mother needs half of. Is this a good plan?

Also, do you know of an attorney in the metro Detroit area that can handle an uncontested divorce, but if my parents do not agree, change to defending my mother against his attorney.

Re: Divorce, when to start?

I am currently an attorney specializing in divorce in the metro detroit area. Divorces can be affordable for people. A lot of times it will depend on how reasonable both sides are. It is not a good idea or really even ethical to have an attorney represent both sides and then switch over if there is a problem. I would suggest that you retain an attorney for your mom and let your dad retain an attorney if he deems it necessary. To discuss this matter further, feel free to contact me at: [email protected].

In some situations, the sooner you get an attorney involved, the better. http://fnabwangu.googlepages.com/
