Legal Question in Family Law in Michigan

ive had my 2 mo. old grandson since 2 wks. old and his 5yr. old sister. so that mom can get on her feet.since her pregnancy she has moved 5 times(always staying with someone). she wants to come get them but hasnt a stable home and hasnt told me were she'll be living.this is her daughters 3rd school and still in kindergarden mom was supposed to get a job and her own place before the children came home. this is my sons child. i dont want to keep them from her but i want the children to be stable before i send them home she is 22 and not married to my son.i have a very stable home and income to care for them. what should i do to insure their security and well being and whatlegal steps do i take to encourage her to get it right for her children please help soon

I am no expert on grandparent rights. The expert on that in Michigan is Richard Victor. I know his fees are very high. However, it is my understanding that a grandparent does not have standing to bring a custody issue by itself. Your son would first have to have something pending before the family law court before you'd have standing to raise the issue yourself. Talk your son into filing something to establish support and visitation and then you could intervene and perhaps get custody yourself. William S. Stern

Richard Victor is indeed one of the experts in grandparenting rights in Michigan. I don't believe that you need his services.

You have several options that an experienced, aggressive and competent family law attorney can work through with you. Amongst your various options are having your son petition for custody and you petition for custody also or alternatively for just grandparent time, or you may choose to petition for a full or limited guardianship. Whatever you do, it is important to hire someone that knows what they are doing!
