Legal Question in Family Law in Michigan

How do I prove that I am my sons legal guardian? My mother left him a life insurance policy and he is 17 yrs old. The company will not release it to me without proof that I am his legal guardian. They are telling me that I need to have a form filled out by the state stating that I am his legal guardian. When I called my local family court office they told me that there no such thing as a "proof of guardianship" for a biological mother. We just want to get his inheiritance a few months sooner so he can buy a car and can afford to pay for insurance.

Guardianship is a legal term for a court appointed caretaker. As mother, you don't need guardianship. They probably mean conservatorship, which is set up to manage a minors funds until 18. Visit me at kliszlaw.com to investigate further. Tim Klisz
