What are my rights?

What are my rights as a grandparent whom more or less raised the grandchild for the first five years of his life and have kept up visitations every other weekend since now that both parents are mentally & emotionally abusing the child? The child wants to live with me. But I am not sure if or how to do that.

Unfortunately, grandparenting rights are limited in Michigan. You may want to file guardianship papers in the probate court - the court could award you guardianship if you can prove abuse or if the parents agree. Good luck.

What you need to do is file a Petition for Guardianship of the Child. This is a probate action. Once you have been granted letters of authority and guardianship status, you will be in a position to file a 3rd party custody complaint for legal and physical custody of the minor child.
