Is there a statue of limitation on collecting 1/2 of an ex spouse's pension if the attorney never filed papers with the ex spouse's employer

There is no specific statute of limitations if a Qualified Domestic Relations Order that specifically sets forth the retirement deal is not entered. However, it usually opens up a mess between the parties, is somewhat time consuming and technical to deal with. It is much easier to do it contemporaneously with entry of the judgment of divorce. To deal with this, unless you have a cooperative ex, I'd definitely get a family law lawyer. You will most likely wind up having the document prepared, with the assistance of the lawyer, by a professional QDRO preparer. William S. Stern
