Legal Question in Civil Litigation in Michigan

my dog attacked neighbors dog

When taking my dog for a walk, my neighbors across the street had their two daucshuads in their front yard not on a leash. Before I could put my leash on my german sheppard, she saw them, ran across the street and bit one of ther dogs. Now being sued for vet bills in excess of $1,000.00. Is comparative negligence my only defense? Is there any way of not having a judgment ruled against me? What about pets being considered property. How do we determine value?

Re: my dog attacked neighbors dog

Where in this narrative do you reveal "comparative negligence"?

You negligently let your aggressive animal run free to enter upon private property and make a vicious and unprovoked attack upon your neighbor's much smaller dachshund - causing it serious injury with resultant mental anguish and medical expenses to the owner.

Your neighbor is seeking only reimbursement for medical expenses which are your responsibility and has asked you for payment which you refused. You left your neighbor with no other recourse than to sue you - which is not a pleasant task.

You're lucky the suit is just for reimbursement and the vet bill is low. If I were your neighbor's lawyer, I would sue for much more.

I believe a Lincoln Park District Court will come to the same conclusion.
