lawyer charging questionable expenses

The Social Security Office of Appeals found that my lawyer was overpaid. They sent him a letter and he then paid me the full amount owed. Then he sent me a letter with ''allowable expenses'' that he said he could charge me.

I have been waiting for over a year and 6 mos. since I filed my disagreement form, and in that time, he has never sent me anything for the ''allowable expenses.'' It was only after he was forced by Soc. Sec. Is this legal?

It sounds like the proper procedure was used. The way it works, is the lawyer's fee is approved after the award. It sounds like the Social Security Administration found what was a proper fee and expenses, sent the notice and then the lawyer refunded the money. It is wierd however that the lawyer was paid by Social Security before the fee was ruled upon. If you paid the fee before Social Security ruled on it, that is improper. William S. Stern
