Legal Question in Wills and Trusts in Michigan

estate dispursement

My father passed away last May at the age of 87, after complications from heart surgury. He was in ICU for 6 months. His estate went through probate, and according to the attorney the final day for creditors to file claims was Dec, 31' 06. The hospital has still not filed a claim, but has sent us notices stating this is not a bill, just informing that they are waiting for insurance payment. Can we dispurse the assets between us 4 daughters at this time, which is only about $5,000 each. If not, how long do we have to wait for the hospital to file a claim. According to the estate papers, if assets are not dispursed within 1 year of my father's death, we will have to file an extension, which will cost us more money. We were planning to use the money to pay for our elderly mother's property taxes. She is in a nursing home and is divorced from my father.

In this case, it appears you have an attorney that is working on the probate matter for you already. I would direct this same question to him/her since there may be facts that are not presented in what you wrote that affect a reply. Here, you are aware of possible bills from the hospital that appear to still be paid/partially paid by insurance or some other contributor.

I generally don't "avoid" answers but this situation is best handled by the attorney working on it now.
