Legal Question in Wills and Trusts in Michigan

Got trouble

Father reciently passed away. 3 children adopted, 1 was not. Problem is the 1 that was not adopted, seems to think that they may possess and control estate assets. We are barely speaking. There was no will that we are aware of. There is a home involved w/ mortgage owed, a loan, cars, stock, etc. None of the other children (adopted) have even been inside the deceased home. I know this must be probated. Should I hire someone to protect my interest in the estate? Can the other child (not adopted) try to take the home from us other adopted children?

Re: Got trouble

You need to obtain legal representation asap. you message is not clear. If there are 4 kids and 3 adopted by dad and one not (natural child) the natural child has no greater priority than the adopted kids. In fact all you have equal priority to become the personal representative of the his estate.

You need to retain an attorney and file a petition to commence an estate proceeding. Whether the estate is informal or formal that is something to decide later.

We specialize in these issues. I suggest you contact my partner Andrew Mayoras. Please refer to our website www.brmmlaw.com to get the phone number.
