Legal Question in Bankruptcy in Minnesota

Motion To Convert

My question is simple, and relates to US Bankruptcy law.

If you have previously filed a chapter 7(2yrs)ago, and you are now filing a chapter 13; does a judge have legal authority to, or is there precedent law to motion for a conversion from 13 to 7 on grounds a 13 would be a hardship resolution in itself

Since you can only file a chapter 7 case once every seven years I don't think your case can be converted. The options in my opinion are to follow through with the chapter 13 (maybe get the plan payments lowered) or dismiss the case. Every six years you can do a Chapter 7. You can't do one for another 4 years. Sick with the 13.
