Child abuse

I have been giving a summons for whooping my child with a belt, and they want to charge me with malicious punishment of a child.and when asked if i did it i told the police what happen on 10-8-01 but i was not read my right can they use that statement in a court of law?

If you weren't under arrest and had not yet been charged, they will say that you volunteered the information - and yes it probably can be used against you.

This is serious. It could be a felony. You need a lot more than Law Guru - you need someone who does criminal defense and family law too. They may not only be charging you criminally, they may start messing with your parental rights.

You should start some counseling right away too. You need to look at how and why this happened and whether might it happen again. You need some counseling, and things will go better for you in court if you do this. Often these things are alcohol or chemical related - have yourself evaluated for chemical dependency problems.

I would also be interested to know if you were on prozac or paxil.
