Custody

If a child's mother were to leave with her child and not notify the father in advance does that constitute as kidnapping? The parents are living together at this time and have shared custody. No legal agreement though.

No. It is not kidnapping in any criminal sense so long as the other parent is aware where the chmother and child are living presently. If the father has not been adjudicated by the court as the child's parent and he has not established custody/parenting rights, he would have no enforceable rights. He must file a Motion in Court to establish those rights.
