Legal Question in Family Law in Minnesota

What determines if I'm ''Underemployed''

I currently work 25 hours a week. When my child support guidelines were set 4 years ago, I was working full time. The reason for my part time status is that I decided to further my education and am also a full-time student. My income is substancially less now. According to the MN state guidelines I should only have to pay about 20% of my income, rather than 25%, that was based on full-time employment. The difference between these two figures is very significant. Any help would be appreciated.

Re: What determines if I'm ''Underemployed''

You can go back to court and prove that you are in school and can only work part-time. You would have to demonstrate what the end result of your education will be and whether you will be able to earn more money after you graduate then you did back when you were working full-time. We offer a free consultation. Please call if you would like to set up an appointment to further discuss your situation. 952-746-4111.
