Legal Question in Family Law in Minnesota

I am going through a divorce, and it is not final yet. We have not been to court for custody of our 3 kids yet, I have worked out a scheldule for who has the kids, and my ex has agreed to it. I also have payed all the bills the last 2 months and have all the receipts to prove that including child care, and house payment. I have a new girlfriend, who teaches toddlers. She has had a backround check done and my kids love her. The problem is my ex says she is not allowed to be at my house or watch the kids when I get called in to work nights, but she won't come and watch the children leaving me with my girlfriend as the only option to watch the children. I would like to know what I can do and what my ex can legally do about my girlfriend being there with me or without me while she babysits. Please help!

She can seek a court order granting her the right of first refusal which would require that she is offerrred the first opportunity to care for the children. If she does not do so, you can make other arrangements.

Until there is such a court order, there is nothing to preclude you from making other arrangements when you are unavailable.
