Legal Question in Insurance Law in Minnesota

setlling a car insurance claim

My car was stolen and totaled in July. My insurance company has still not attempted to settle my claim with me. When they do attempt to settle, I would like compensation for other factors such as, I had a full tank of gas in the car when it was stolen and I also had to miss a day of work. My insurance company offered a rental car for up to $30 a day for 30 days. I turned it down because I did not expect this process to take as long as it has. So instead of the rental car I have been putting miles on my parent's car. Also, my claims representative went an entire two weeks without giving me an update and did not return my three phone calls during that time. I am only being taken seriously because I filed a grievance with the corporate office. They continue to tell me that they are waiting on the police and accident report while they have had my written person to obtain them for two weeks. I was able to get my own copy of those records this past week and it took no more than ten minutes. When I asked them about this they admitted that my permission slip sat on my representative's desk for over a week without her doing anything with it. Can I receive any money for their delinquency in attempting to resolve this?

Re: setlling a car insurance claim

1) You might be able to be compensated for the full tank of gas if you can prove it: for example receipts. 2) I do not believe you can recover for the lost work unless your insurance contract allows it. 3) I do not believe you can receive money for their tardiness unless the insurance contract provides for it. You can contact the Minnesota Insurance Commissioner and file a complaint against the insurance company regarding their handling of this case. Good luck, and I am sorry about your insurance company's actions in this matter.

If my answer is satisfactory, I greatly appreciate positive feedback.

Please be aware that my answer is not legal advice, it is merely information. You and I have not entered into an attorney/client relationship. The only way that I am legally responsible for your legal rights is if you have signed a written retainer agreement with my law firm.
