Auto Accident Insurance Dispute

When you're in an automotive accident miles from home and they other party is at fault 100%, your insurance company forces you to repair your automobile miles from home and the mechanic miles from home does not repair it correctly, what are your rights? Especially, when your automotive insurance company refuses to communicate with you and refuses to pay for any of the remaining repair work that needs to be done, what are your rights?

Do I need a lawyer?

You have the right under the policy to have your auto put back as closely as can be to the condition it was in prior to the accident.

If the mechanic performed substandard repairs, you should be able to get the repairs done properly and get it paid by the insurer. The insurer will probably deny the claim and you will need a lawyer to pursue the recovery. the only economically feasible way of going against the bad mechanic would be conciliation court. But you would have to do that in the county in which the mechanic performed the repairs. Not very convenient.

Also, there are time when a car is damaged badly enough that there is hidden damage that was not visible at the time of the estimate. Most reputable insurance companies will pay the subsequent repairs if it can be documented that these repairs were necessary due to the accident in question.
