Legal Question in Personal Injury in Minnesota

Passenger in a no fault car accident in a vehcile with no insurance

What are my rights in Minnesota in a no fault car accident while I was the passanger in a vehcile whom was not at fault but the vehicle I was in had no car insurance? I have a lawyer but was denied loss of wages and $20,000 of my medical. I recieved a broken pelvis and had a metal plate inserted that will never come out. I am 22 yrs.old and have no car or medical insurance of my own. I do not own my own vehicle. I live on my own. What are my rights? My current lawyer has not been helpful. My only fault in this whole case is I DON'T KNOW. I've never been in a accident or broke a bone..I now deal with a sore leg and pain on a daily basis for the rest of my life. Please help me understand what it is that I need to do.

Thank you.

Re: Passenger in a no fault car accident in a vehcile with no insurance

The answer depends on some additional facts that you did not provide. Who owned the car in which you were a passenger? Do you live as a family member with someone who has a usable car with no insurance? If you live as a family member with someone with an uninsured car you would not have no fault coverage. However, if you did not live with this person then you are probably entitled to coverage for no fault benefits. These would come from what is known as the assigned claims plan. If your attorney is not familiar with these issues you need another attorney.

I would be happy to talk to you further about this. My law firm handles only personal injury matters like this and both my partner and I are certified as civil trial specialists. We handle cases throughout the State of Minnesota. If you would like to talk to me directly about this give me a call at 1-800-235-7600 or e-mail me at [email protected].
