Legal Question in Family Law in Mississippi

Cancel QDRO

I was divorce and a Qualified Domestic Relations Order was placed on my husband' pension. We have since remarried and want to canel that order. He no longer works for that company (let go) and they are requiring a court order for him to gain access to move the pension. Is there a standard form? Can I just file a joint agreement with an order attched asking for the Judge to revoke the order. Will he sign such with going to court? I can provide all the documents. Final Divorce Decree, QDRO, marriage certificate. Any suggestions would be appreciated.

Re: Cancel QDRO

There is no standard form for canceling a QDRO in Mississippi. You will have to go back to the Court where your QDRO was issued, because that Court has continuing jurisdiction over the divorce matter, and therefore can modify or vacate orders issued. In this situation, you do need an attorney, but it shouldnt be very expensive as this a joint motion. However, you will both likely have to appear on the day the Motion is made.
