Sueing an for use of property

I loaned my boyfriend the use of a cellular telephone in my name. He ran the bill up to $1500.00. While we were still dating he was making payments as usual. Now that we've broken up, he has refused to continue making payments. Can I take him to small claims to make sure he continues to pay?

Yes, but you will have to prove that he used your telephone and he agreed to pay by for the use. It will be useful if he has made admissions in the presence of a witness or in writing and there is proof of payments by him. If he testifies, try to also get his social security number, date of birth, and place of employment so you can garnish his pay.
