Legal Question in Consumer Law in Missouri

This information is concerning a Great Seneca Financial judgment from an old credit card that my ex-husband had. When we divorced in 2007, my ex- was supposed to pay off this judgment "by verbal agreement only" (stupid me not to have gotten that lined out in the divorce).

Original debt from Household Bank Great Seneca obviously purchased this debt from Household Bank.

The judgment was filed in 2005 by Gamache and Myers located in Town & Country, Missouri. At that time, we lived in Branson, Missouri. I now live in Houston, TX.

I spoke with Tracy at Gamache & Myers at 1-800-404-0220 ext 6755. I informed Tracy that I had the money and could easily send her a cashiers check or money order today. She indicated that the account #5CC06800 was closed on 09-17-07 and that unless the attorney agreed to re-open the account, there was nothing else she could do. She also stated that in order to re-open the account that they would have to contact Great Seneca Financial to do so.

Tracy at Gamache & Myer told me she would talk to the attorney and get back to me. She never has returned any of my calls. I have also called them 3-4 other times. All I get is the run-around. Never can get through to Tracy. They say she is not in or I get transferred to a voice-mail. And no one else will give me any information. They just say to call back when Tracy is there.

According to a friend of mine who is having the same problem, Great Seneca Financial no longer exists. So, I searched for infomation on the web for Great Seneca Financial and found some very interesting information.

www.creditreportproblems.com I found several entries concerning this company. Seems like I am not the only one having problems with them. Entries like - company unreachable. AKA Wolpoff & Abramson. Off the radar. Great Seneca sold to Mann Bracken which has been out of business since Jan 2010. The last entry in that discussion forum states Great Seneca dissolved their business as of 03/25/09.

My new husband and I are purchasing a new house and the mortgage company we are using is telling me that the only thing holding up closing on this house if this Judgment from Great Seneca

So, my question is....how can I get this judgment removed? I have the $$ to pay, but I cannot find anyone to give it to. And, when I give this money, how will I be sure that once it is paid that they will report to the courthouse that it is paid. Once the courthouse validates the payment, I assume that they will enter into their system as PAID.

Any help on this matter would be greatly appreciated.

Mrs. Clevinger,

Waht you need is a Satisfaction to be filed in the county where the judgment was entered. Normally the judgmetn creditor (plaintiff) attorney does this. But, where they won't, the judgmetn debtor (defendant) has a mechanism to do this. You will have to allege that the satisfaction needs to be entered (may require paying the money into the court) and then set it for hearing. If no one for the other side appears, then the jduge should enter the Satisfaction. You may have to repeat this process in other courts where they may have registerd the judgmetn. But, they are all easier after the first one. Once you have the Satisfaction, you send a copy to the mortgage company.
