drug charge?

my daughter just told me that she was arrested for having two twenty bags mariuna there was a $250 bail she is only 18 and made a bad choice what are her chances of this being a felony on her record and can this be removed?

First of all, try to remain calm. Although this can be a very serious situation, it is one that comes up all of the time and we can certainly handle it in a way that will minimize the adverse consequences. I'm not sure what you mean by "two twenty bags". Do you mean that each bag had twenty grams of marijuana? Or, do you mean that each bag would sell for twenty dollars? Or, do you mean something else entirely? If your daughter was charged with being in possession of more than 35 grams then she is charged with a felony. More specifically, this would be a Class C Felony which carrries a sentence of up to seven years. If this is her first offense and if the State has enough legally obtained evidence to convict, then it is very likely that she will be able to negotiate a plea bargain which will not only keep her out of prison but in many cases will avoid a conviction being entered upon her record.
