Legal Question in Family Law in Missouri

missouri emancipation law

Our daughter recently passed away. Her son is 15 years old. He has lived with our daughter & Her husband for 10 years. He has two younger half-brothers. His father wants him to come live with him, but our grandson wants to stay with his step-father & brothers. Does he have a chance in court?

When can he be emancipated in Missouri?

Re: missouri emancipation law

Unless the step-father adopted the fifteen year old, the natural father has the legal right to custody. The fact that the child wants to live with the step-father will not be sufficient to obtain a court order. The child will be emancipated at seventeen, when he marries, when he moves out and becomes self supporting, or perhaps when he joins the miitary.
