Legal Question in Civil Litigation in Missouri

Return of property loaned

My fiancee financed a truck in his name for his ex girlfriend under the agreement she would get it changed to hers and make the payments. She never got it changed and is in default on the payments. The bank wants to repossess it and she has been notified to turn it over. She refuses to turn it over and keeps it hidden. The police will not get involved because he gave her permission to drive the truck even though he has notified her to turn the truck over. HELP? any recourse?

It is closing the door after the horse is out of the barn, but this is why we tell people to get things in writing.

Your fiancee should probably contact an attorney and sue the girlfriend for "conversion." He should seek damages sufficient to pay the truck current. He might also consider hiring a private detective to see if he can find the vehicle.

This is a difficult situation. Good luck.
