If a will stipulates the estate is to be divided equally between people and one of the people is deceased, will that 1/3 be given to the deceased's heirs?

There are situations where that will not occur. They are based mostly upon the language of the will. For the most part, a valid will that devises to three people will pass property to them or their heirs at law.

If there is a disagreement between the heirs, as to predeceacing devisees, each of them should employ counsel to evaluate the proposed will as to their interests.
