Legal Question in Employment Law in Montana

Part time vs full time
A friend was hired for a small publishing company to work part time (less than 32 hours/week), therefore with no benefits. It turns out he is working 40 hours/week anyways. Is there a limit to how long this can go on before they have to give him full time and its benefits? Thanx
