Legal Question in Family Law in Nebraska

Non Costodial Parent bill paying

My wife's X-Husband, who has joint custody of thier only child(15) is insisting that she pay half of the expense of an elective dental procedure($9000). My wife's only source of income is a small daycare (3 children) run from her home (apr $150 a week gross). Is she liable for this expense.

Re: Non Costodial Parent bill paying

The first place to look for an answer to your question is the divorce decree. What exactly does the order say with regard to elective dental/medical procedures. If it is silent on the matter, then to force your wife to pay half, the ex will have to attempt to modify the divorce decree. IF your wife signed anything with the Dentist's office agreeing to be a liable party she can be sued or have other collection efforts taken by the dentist for any unpaid amounts.

Good luck.
