h1B WAS DENIED

for the question When it was denied? How long have you been ''out of status''? Are you still working for your first H-1B employer? Were you actually on H-1B status before this employer filed the H-1B petition?

it was denied this year ,i have not been out of status , i am not on H1-B, i am currently on OPT(optional practical training ) which goes till year end ,

My H1 was denied , when my previous company filed it this year, now i have joined another company they want to hire me for long term , i require H1B to work for them after my OPT expires.

So in this case ''can i re-apply my H1B through the new company i have joined ? if yes what are my chances of getting approved,

If you are in a valid OPT status and the quota for H-1B for FY2010 is still open, then, yes, a new employer can file a new petition on your behalf, requesting a change of status.
