Nebraska partition suit
My dad died and I inherited two properties with my brother. The apartment we had an offer to sell but my brother won’t sign papers. He filed a partition suit, I was notified it will go to public auction.
Also he refused to divide the land and I was also notified it will go to public auction. Can I fight this in court? Does it go to court then auction

Partition of title is an absolute right under Nebraska law for any party named on the title. It is also the least efficient and most expensive way of selling and dividing interest in real estate. If you can't come to terms with your brother that are agreeable to both of you, you will need to hire an attorney to intervene on your behalf.
